Keating, AI , Comm Development Director <br /> FROM: Stan Boling, AICP <br /> Planning Director <br /> DATE: June 18, 2013 <br /> SUBJECT: Consideration of Amendments to Land Development Regulations (LDRs) Chapter <br /> 915,Planned Development,to Change Mixed Use Development Regulations To Be <br /> Consistent with the Revised Comprehensive Plan Mixed Use Policy 5.6, and to <br /> Delete an Out-of-Date Table (Appendix) in Chapter 952, Traffic <br /> It is requested that the data herein presented be given formal consideration by the. Board of County <br /> Commissioners at its regular meeting of July 2,2013. <br /> DESCRIPTION& CONDITIONS <br /> Currently, the county is considering certain amendments to its Future Land Use Element mixed use <br /> development policy(Policy 5.6). Those proposed amendments,if adopted,will modify certain requirements <br /> for mixed use projects in residential areas. Among the proposed changes are increasing the commercial area <br /> allowance for projects in low density areas,allowing fuel sales in mixed use projects,and providing for some <br /> commercial development to occur prior to the commencement of residential development. A Board hearing <br /> (final hearing)for adopting the proposed Policy 5.6 amendments is scheduled for July 2,2013,immediately <br /> prior to consideration of the subject LDR amendment. <br /> As structured,the county's land development regulations(LDRs)implement comprehensive plan policies and <br /> must be consistent with the comprehensive plan. In fact,the LDRs are subservient to the comprehensive plan <br /> and,whenever there is a conflict between the two,the comprehensive plan prevails. In many cases,changes <br /> to a comprehensive plan policy require changes to a corresponding LDR section. In this case, changes to <br /> mixed use Policy 5.6 require changes to the mixed use development regulations of Chapter 915. To keep the <br /> county's mixed use regulations up to date with respect to the Policy 5.6 amendments, staff has prepared <br /> amendments to Chapter 915 that match changes proposed to Policy 5.6 (see attachment#6). <br /> In addition to the Chapter 915 changes, staff has also prepared a minor LDR amendment to Chapter 952, <br /> Traffic. That amendment involves deletion of an out-of-date and obsolete right-of-way table that currently <br /> constitutes the appendix to Chapter 952.
