ORDINANCE NO.2013 - <br /> Section 1. Enactment Authority. <br /> Article VIII, §1 of the Florida Constitution and Chapter 125, Florida Statutes vest broad home <br /> rule powers in counties to enact ordinances, not inconsistent with general or special law, for the <br /> purpose of promoting the public health, safety and welfare of the residents of the county. The <br /> Board specifically determines that the enactment of this ordinance is consistent with general or <br /> special law, and is necessary and appropriate to promote.the health, safety and welfare of the <br /> residents of Indian River County. <br /> Section 2. Findings. <br /> The Board finds that the above "Whereas" clauses are true and correct, and hereby incorporates <br /> such clauses as findings of the Board. <br /> Section 3 Adoption of Chapter 316 of the Code of Indian River County (the"Codes. <br /> Chapter 316 of the Code is hereby adopted, as follows (new language is indicated by underline): <br /> Section 316.1. Title. <br /> This chapter shall be known as the "Indian River County Fertilizer and Landscape Management <br /> Ordinance." <br /> Section 316.2. Definitions. <br /> For the purposes of this chapter the following terms shall have the following meanings: <br /> "Administrator" shall mean the County Administrator, or an administrative official of the County <br /> designated by the County Administrator to administer and enforce the provisions of this chapter. <br /> "Application" or "amply" shall mean the actual physical deposit of fertilizer to turf or landscape <br /> plants. <br /> "Alicator" shall mean any Person who applies fertilizer on turf and/or landscape plants in <br /> Indian River County. <br /> "Board" shall mean the Indian River County Board of County Commissioners. <br /> "Best Mana ement Practices" shall mean turf and landsca a ractices or combination of <br /> practices based on research field-testing, and expert review determined to be the most effective <br /> and macticable on-location Leans,_ including economic and technolo ical considerations for <br /> improving water quality conserving;water supplies and protecting natural resources. <br /> F.•411fomey�LMdn�OenerafViesoludons&Ordlnanus\OrdllronccslFerlifizer4Node!Ferdliur Ordinance-1013(Fnal)(Augusf 7).dacz <br /> Page 2 of 10 <br /> 587 <br />
