Rick Scott <br /> GOVERNOR D Jesse Panuccio <br /> (W EXECUTIVE DIRECTOR <br /> FLORIDA DEPARTMENTaf <br /> ECONC)MIC OPPORTUNITY <br /> July 16, 2013 <br /> Mr. Bruce Barkett <br /> Collins, Brown, Caldwell, Barkett,Garavaglia&Lawn <br /> Post Office Box 3686 <br /> Vero Beach, Florida 32964-3686 <br /> RE:Waterway Village Development of Regional Impact(File No.ADA-10-2004-003) <br /> —Non-substantive Modification <br /> Dear Mr. Barkett: <br /> We have received your letter of May 28,2013,asking for our assistance in determining whether the <br /> changes proposed for the Waterway Village Development of Regional Impact can be reviewed pursuant <br /> to Section 380.06(19)(e)2.1., Florida Statutes(F.S.).The proposed resolution would amend the <br /> development order to require biennial status reports rather than annual status reports. <br /> The Department, in consultation with Indian River County and the Treasure Coast Regional Planning <br /> Council agrees that biennial status reports are allowed pursuant to Section 380.06(18), F.S.The <br /> Department considers the change in reporting similar in impacts to the changes enumerated in sub- <br /> paragraphs 380.06(19)(e)2.a-j, F.S.,and do not create the likelihood of any additional regional impacts. <br /> Thus, pursuant to sub-paragraph 380.06(19)(e)2.1, F.S.,the proposed change does not require the filing <br /> of a Notice of Proposed Change. <br /> The change to the development order should be considered in accordance with local procedures, <br /> including requirements for notice to your client and the public. The changes can either be denied,based <br /> on the County's comprehensive,plan and land development regulations,or adopted with or without <br /> conditions. Following adoption, the revised development order should be rendered to the state land <br /> planning agency.
