July 31, 2013 <br /> (W Page Two (2) <br /> The electronic filing program is based on Internet access using standard web-browsing <br /> software. The system provides for direct entry of campaign finance information, as well as, <br /> upload of such information from campaign finance software certified by the Division of Elections. <br /> Safeguards are in place to prevent unauthorized access to electronic filing system functions. An <br /> electronic receipt is issued upon submittal of a campaign finance report indicating and verifying <br /> that the report has been filed. <br /> The program also includes a conspicuous statement immediately following the log-in page <br /> notifying users that campaign finance reports must be completed and filed through the <br /> electronic filing system not later than midnight of the day required by law and that late-filed <br /> campaign finance reports are subject to the penalties prescribed under Section 106.07(8) or <br /> 106.29(3), Florida Statutes. Our office will encourage those filing campaign finance reports to <br /> submit the report by 5 p.m. on the due date, in the event that the person filing the report needs <br /> any assistance from elections personnel. The report is technically not delinquent until after the <br /> midnight deadline. <br /> Campaign finance reports filed through the electronic filing system are considered to be certified <br /> as to the correctness within the meaning of Section 106.07(5) or 106.29(2), Florida Statutes, by <br /> (W the candidate and the candidate's treasurer, in the case of a candidate; the political committee's <br /> chair and the political committee's treasurer, in the case of a political committee; or the party <br /> executive committee's chair and the party executive committee's treasurer, in the case of a <br /> party executive committee of a political party. <br /> Each person given a secure sign-on to the electronic filing system is required to sign a written <br /> statement acknowledging their responsibilities and the rules associated with the electronic filing <br /> system (see attached). The statement also indicates the procedure for filing campaign finance <br /> reports in the event that the electronic filing system is not operable. <br /> I respectfully request that the Board of County Commissioners adopt the proposed resolution <br /> regarding electronic filing requirements for campaign finance reports for local candidates, <br /> political committees and party executive committees of a political party who qualify with the <br /> Indian River County Supervisor of Elections. <br /> Very truly yours, _ <br /> Win River Co.
