INDIAN RIVER COUNTY ORDINANCE NO. 86 - 36 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING INDIAN <br />RIVER COUNTY ORDINANCE NO. 85-44, THE GENERAL PROVISIONS SECTION <br />OF THE ZONING CODE, ESTABLISHING SECTION 25(S) STORMWATER DIS- <br />CHARGE FROM SINGLE-FAMILY LOTS; PROVIDING INCLUSION IN CODE; <br />SEVERABILITY; AND EFFECTIVE DATE. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMIS- <br />SIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />SECTION 1. <br />Indian River County Ordinance No. 85-44 is hereby amended to <br />establish Section 25(S) of the Zoning Code to read: <br />To ensure that stormwater runoff is adequately managed, each <br />applicant for single-family home building permit approval shall <br />submit a conceptual drainage plan as part of their building plot <br />plan or parcel survey, if the building lot or parcel is not <br />located in a subdivision having a positive drainage system previ- <br />ously approved by the Public Works Director. A list of "previous- <br />ly approved" subdivisions shall be on file at: <br />1. the Building Division, <br />2. the Public Works Division, and <br />3. the Planning and Development Division. <br />The conceptual drainage plan shall depict the existing or proposed <br />stormwater management system including swales, finished ele- <br />vations, transition grades to abutting property, any off-site <br />tributory drainage entering the property, existing and proposed <br />drainage system improvements (if needed), and other pertinent <br />information as may be required by the Public Works Director. <br />All conceptual drainage plans required by the Public Works Direc- <br />tor must be approved by the Public Works Director prior to the <br />issuance of a building permit. The Public Works Director shall <br />approve conceptual drainage plans and approve revisions to such <br />plans if it is determined that by constructing in accordance with <br />the plans. <br />1. the stormwater runoff generated from a 10 year 24 hour <br />storm (such storm producing 7.44" of rainfall) will be <br />retained on the applicant's building site; or <br />2* the stormwater runoff generated from a 10 year 24 hour <br />storm (such storm producing 7.44" of rainfall) will be <br />partially retained on the applicant's building site and <br />the remainder will be legally routed off of the appli- <br />cant's building site to a publicly or privately main- <br />tained drainage system having sufficient capacity to <br />adequately accommodate the additional stormwater run-off <br />to be created by the proposed structure(s). <br />No certificate of occupancy shall be issued where improvements <br />depicted upon a conceptual drainage plan approved by the Public <br />Works Director have not been constructed in accordance with the <br />approved plan. <br />
