JUN 18 Iffil <br />ROOK 3 PAGE 722 <br />percentage of 82%, the analysis indicates that the subject <br />amendment request is consistent with policy 1.23. <br />DCA Objections <br />-As indicated in the Description and Conditions section of this <br />staff report, DCA had several substantive objections to this <br />request. It is staff's position that these have been adequately <br />addressed in this report. Both the buffering issue and the node <br />expansion concern have been addressed, and adequate justification <br />has been provided. In addition, staff has revised the public <br />facility capacity analysis to consider the most intense use allowed <br />by the proposed land use designation and to address adopted level <br />of service standards. Based upon these changes, staff feels that <br />DCA's objections have been resolved. <br />CONCLUSION <br />Public facility concurrency requirements are important factors in <br />evaluating any land use amendment or rezoning request. Concurrency <br />requirements, however, are not the only criteria. Unlike other <br />comprehensive plan policies, though, concurrency requirements by <br />themselves can be a reason for denial of a request. Even if all <br />other comprehensive plan policies are satisfied by a request, a <br />lack of concurrency would be a reason for denial. <br />In this case concurrency for drainage, solid waste and potable <br />water can be satisfied with the proposed amendment. Although <br />capacity for wastewater services is not presently in place, the <br />applicant's execution of a developer's agreement to ensure that <br />these facilities will be provided would meet the concurrency test. <br />With a positive concurrency finding and a finding of consistency <br />with other plan policies, the proposed amendment may be approved. <br />RECOMMENDATION <br />Based on the analysis performed including the Planning and Zoning <br />Commission's recommendation, staff recommends that the Board of <br />County Commissioners _increase the size of the City of Vero Beach to - <br />South Relief Canal Commercial/ Industrial Node by 6.8 acres, change <br />the land use designation of the subject property from M-2 to <br />commercial, and rezone the property from RM -6 to OCR. <br />1-- ZONING BOLNDARIES <br />-LAND USE BOUNDARIES <br />SUBJECT PROPERTY <br />l.tth-a , <br />M <br />M <br />
