the previous meeting and they have been relying on the Board's <br />previous approval of the CL. He, therefore, requrested that the <br />Board follow through on this. <br />Commissioner Eggert advised that she simply would continue <br />to be consistent with her vote starting back with the WalMart <br />parking lot. <br />Commissioner Scurlock pointed out that the purpose of having <br />a public hearing is to continue to get public input, and he felt <br />there is no point in having a public hearing if you can't ever <br />change your mind. <br />Chairman Bird asked what action Board members wished to <br />take, and no one offered a Motion. <br />MOTION WAS OFFERED by Chairman Bird to approve the <br />subject request to amend the Comp Plan and rezone <br />to CL. THE MOTION died for lack of a second. <br />Chairman Bird noted that we have to do something with this <br />item, and Commissioner Eggert asked if OCR would seem better to <br />him than PRO. <br />Director Keating advised that PRO wouldn't even necessitate <br />the Comp Plan amendment and also it is limited to 5 acres. <br />Asst. County Attorney Collins advised that when he and <br />Director Keating talked with the DCA about the subject property, <br />they did have concern about transition to the north, and he <br />remembered that at that meeting, he did say OCR, but really did <br />not think they know the difference between OCR and CL. He was <br />not sure that he knew the difference either without looking it <br />up, but he did know the DCA is expecting something that gives a <br />good transition. <br />Chairman Bird felt if Attorney Collins does not really <br />understand the difference, he certainly doubted that someone in <br />Tallahassee does. CL is what the property owner wants, and he <br />has to believe it is a reasonable transition between the packing <br />house and WalMart and the multi -family to the north. Unless it <br />is really harmful, why not support what the property owner wants? <br />Commissioner Scurlock commented that at the earlier meeting, <br />he had wished to be assured that CL is considered a transitional <br />usage between residential and commercial, and now staff is saying <br />that OCR is a better transition. <br />Director Keating felt that in the heirarchy of intensity of <br />non-residential zoning districts, OCR is the least intense where <br />CH would be the most intense, and the degree of buffering from a <br />use standpoint would be enhanced with the lower intensity. <br />JUN 18 1991 135 BOOK � F' wt �� <br />
