The CARL program should not have anything to do with <br />what we are doing today, and in his mind, it does not. <br />Chairman Bird determined that no one else wished to be <br />heard. He then closed the public hearing and asked what was the <br />Board's pleasure. <br />MOTION WAS MADE by Commissioner Scurlock to adopt <br />Ordinance 91-28 amending the Land Use Element of <br />the Comp Plan, including a new C-3 Conservation <br />District at a density of 1 unit/2j acres for xeric <br />scrub communities as recommended by the applicant <br />rather than the 1/5 recommended by staff. <br />Commissioner Eggert asked if Commissioner Scurlock wished to <br />include eliminating the sentence regarding infrastructure in <br />Attachment "A", but he noted that sentence only says "may be" not <br />"shall," and he had no problem with that. <br />COMMISSIONER EGGERT SECONDED the above Motion. <br />Discussion then followed regarding requiring a larger buffer <br />or setback from the river, and Attorney Watts pointed out that <br />the applicant doubled what is in the ordinance. <br />Commissioner Eggert agreed, but noted it is to be an 100' <br />natural buffer and she believed they can have a house touching <br />that natural buffer. <br />Mr. Watts pointed out that since they are doing clusters, <br />80% of the river bank wouldn't have anybody, and the other 20% <br />would have 1001. <br />Commissioner Eggert expressed concern about being able to <br />get equipment in there to build houses and still have "undis- <br />turbed native vegetation." She felt they still would have to set <br />back another 10' or 15' in order to accomplish that. <br />Environmental Planner DeBl0ls, to give the Board some <br />perspective, advised that the actual area of scrub is roughly <br />1500/1800' in width, and Commissioner Scurlock asked him if the <br />100' setback is acceptable. <br />Planner DeBlois advised that there are other significant <br />rivers in Florida where they have gone up to 1,000' and he has <br />heard of 5001. From the soil scientists' viewpoint, however, the <br />100' setback seemed to be sufficient, but no less. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously (4-0) <br />Commissioner Wheeler not being present. <br />- 94 - <br />
