Unit No. 2, being the northerly ten (10) feet of Lot 55. It is the <br />petitioner's.intention to construct a concrete swimming pool deck <br />around an existing swimming pool on the subject property. <br />The current zoning classification of the subject property is <br />Single -Family Residential District. The Land Use Designation is L- <br />2, allowing up to six (6) units per acres. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell Telephone Company, <br />Florida Power & Light Company, United Artists Cable Corporation, <br />the Indian River County Utilities Department and the Road & Bridge <br />and Engineering Divisions. Based upon their reviews, it was <br />determined that there would be no adverse impact to utilities or <br />drainage on the subject property by the release of the easement. <br />RECOMMENDATION: <br />Staff recommends to the Board, through the adoption of resolution, <br />the release of the rear lot ten (10) foot utility and drainage <br />easement, being the northerly ten (10) feet of Lot 55, Dixie <br />Gardens Subdivision, Unit No. 2, as recorded in Plat Book 4, Page <br />49 of the Public Records of Indian River County, Florida. <br />and <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously (4-0, <br />Commissioner Bowman being absent) adopted Resolution <br />91-71, abandoning certain easements in the Dixie <br />Gardens Subdivision Unit No. 2, Lot 55. <br />RESOLUTION NO. 91-71 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, ABANDONING CERTAIN <br />EASEMENTS IN THE DIXIE GARDENS <br />SUBDIVISION UNIT NO. 2, LOT 55, <br />ACCORDING TO THE PLAT THEREOF AS <br />RECORDED IN PLAT BOOK 4, PAGE 49, OF <br />THE PUBLIC RECORDS OF INDIAN RIVER <br />COUNTY, FLORIDA. <br />WHEREAS, Indian River County has easements as described below, <br />WHEREAS, the retention of those easements serves no public <br />purpose, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County, Florida that: <br />This release of easement is executed by Indian River County, <br />Florida, a political subdivision of the State of Florida, whose <br />mailing address is 1840 25th Street, Vero Beach, Florida 32960, <br />Grantor, to Jerry.W.
