MCCoy40% <br />Staff Planner, Current Development <br />DATE: March 27, 1991 <br />SUBJECT: Roland and Marion Baur's Request to Abandon a Portion of <br />78th Court Between 134th Street and 135th Street. <br />It -is requested that the data herein presented be given formal <br />consideration by the.Board of County Commissioners at its regular <br />meeting of July 2, 1991.. <br />DESCRIPTION AND CONDITIONS: <br />Roland and Marion Baur have submitted a petition for the <br />abandonment of a portion of 78th Court between 134th Street and <br />135th Street. Per guidelines established by the Board of County <br />Commissioners, the petition was reviewed by all County divisions <br />and utility providers having jurisdiction within the right-of-way. <br />All reviewing agencies have recommended approval of the <br />abandonment, with the provision that the entire right-of-way be <br />retained as a drainage and utilities easement. While the County is <br />retaining the entire portion of the subject right-of-way as an <br />easement; the property owners will benefit by being able to build <br />in the old setbacks and use the easement (abandoned right-of-way) <br />for setback purposes. <br />This portion of 78th Court is not part of the roadway system as <br />noted on the County Thoroughfare Plan, and is not needed for the <br />thoroughfare system. This right=ef-way is presently undeveloped <br />and is heavily vegetated. Staff has determined that this "paper <br />street" segment is not needed for future neighborhood traffic <br />circulation, nor for convenient access to any private property. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to 78th Court <br />and .that the Chairman of the Board of County Commissioners be <br />authorized to execute the attached resolution (Attachment #3), with <br />the condition: <br />1. that a drainage and utilities easement be retained over the <br />entire subject right-of-way. <br />31 <br />JUL 2 1991 <br />BOOK 83 F'A`ut 1 <br />
