Selling of bait and renting of fishing equipment in direct competition <br />with tax paying, licensed businesses. (Bait sales and fishing <br />equipment rentals are not permitted by the License Agreement.) <br />6. Jet skis. The term "power vessels" in Paragraph la of the License <br />Agreement should be qualified as to whether or not it includes jet skis. <br />(The Board has denied permission for jet skis to be rented at the <br />Causeway in the past . ) <br />7. Food or beverage sales, including alcohol on County property. Absent <br />express consent, these are not licensed activities. <br />8. The portion of the County park premises licensed at the Wabasso <br />Causeway is not specifically identified, i.e., North, South, East, West, <br />etc. <br />9. Workers' compensation insurance needs to be provided. Since the <br />License Agreement is with a corporation, all employees of the <br />corporation must have workers' compensation coverage. <br />It should be noted that the letter from Abyss Maritime, Inc. applying for <br />use of the Causeway dated June 4, 1991 was specifically limited to boat <br />rentals, including "power boats" rather than "power vessels". The second <br />paragraph of the letter of application indicated that there would be no <br />advertising required at any time and that the use of the site would be in <br />daylight hours only. <br />Along with the application, Abyss Maritime, Inc. provided a copy of the <br />Personal Watercraft Rental Contract Terms and Conditions. Paragraph 8 <br />precludes operation of the personal watercraft while under the influence of <br />alcohol, narcotics, barbiturates, drugs or marijuana. Similarly, Paragraph 7 <br />of the Personal Watercraft Rental Disclosure makes consumption of alcoholic <br />beverages cause for termination of the use of the watercraft. <br />CONCLUSION: <br />The Risk Management Department and Attorney's Office, as well as the <br />applicant, request some direction from the Board as to which of the three <br />principal options listed above is preferred, along with any comments <br />regarding other matters which have arisen in the first week or two of <br />operation. <br />RECOMMENDED OPTION: <br />Modify the License Agreement to exclude those power vessels on which <br />satisfactory insurance cannot be obtained; and add the following terms: <br />- Hours of Operation: 9:00 a.m. to 6:00 p.m. <br />- Signs conforming to County code. <br />- No water skiing. <br />- No bait and equipment sales and rentals. <br />- No jet skis <br />- No food, beverage or alcohol sales <br />- Location on Causeway <br />58 <br />
