County Attorney Collins reviewed the following: <br />TO: The Board of County Commissioners <br />FROM: tk William G. Collins II - Assistant County Attorney <br />DATE: July 1, 1991 <br />SUBJECT: Grand Harbor Development Order - Paragraphs 43, 44 and 45 <br />Relating to Disaster Preparedness <br />The Development Order for Grand Harbor precludes certificates of occupancy <br />in excess of 300 until arrangements are made for emergency evacuation. The <br />attached agreement provides that River Harbor, Inc. make cash contributions <br />in lieu of the shelter requirements, subject to the approval of the <br />Department of Emergency Services. The agreement provides that River <br />Harbor, Inc. will donate 1.1 acres of land at the northwest corner of the <br />intersection of Indian River Boulevard North Extension and proposed 45th <br />Street Easterly Extension for a future fire station and emergency services <br />station. The County will have three years to construct the fire/EMS station, <br />or the land would revert to River Harbor, Inc. upon a payment of <br />$60,000.00. Additionally, River Harbor, Inc. will make a cash contribution <br />of $90,000.00 in lieu of construction of shelter space, $50,000.00 before the <br />301st certificate of occupancy is issued and the balance of $40,000.00 to be <br />paid prior to the 1,201st certificate of occupancy being issued, unless there <br />is inadequate emergency shelters for 19% of the then existing Grand Harbor <br />population two years from this date, in which case the final $40,000.00 would <br />be due in two years. <br />Attorney Collins confirmed that this agreement would satisfy <br />the requirements under the D.O., and the attorneys for River <br />Harbor, Inc. are holding a $50,000 cash payment in trust pending <br />our approval of this agreement. <br />Commissioner Eggert inquired where the people from Grand <br />Harbor go for shelter now, and Emergency Management Director <br />Wright advised that as of now they would go to a shelter south of <br />Grand Harbor in the Vero Beach area. We plan with these funds to <br />retrofit either Middle 6 or 7 School in this area and use that as <br />a shelter in cooperation with the School Board. <br />20 <br />
