r <br />AUG 13 TOM <br />BOOK 8 ['A.GE ti <br />Commissioner Scurlock asked if there are any crossing gates <br />which eliminate the possibility of going around them. <br />Director Davis said there are not. There are various types of <br />gates, the most visible being the cantilever type like the one on <br />16th Street which covers not just the roadway but also the <br />pedestrian path. It's difficult to go around them because they do <br />overlap when they close. <br />Commissioner Bowman questioned the cost of taking any action. <br />Attorney Vitunac suggested, since this temporary rule just <br />came out about ten days ago, one method may be for us to wait and <br />see what the rest of Florida does. <br />Commissioner Eggert suggested we inquire of FACO and the <br />League of Cities as to what their plans are, express this Board's <br />feelings on it, and not involve ourselves in any expenditure of <br />funds at this point. <br />Vice Chairman Wheeler agreed, if we have a clear position, we <br />should let FACO and NACO know where we stand and wait and see. <br />Commissioner Scurlock took the position to support our <br />ordinance, to convey that to the state association of Florida, the <br />League of Cities, and other appropriate groups which are involved, <br />and investigate the potential cost to litigate because we do not <br />want to spend money to litigate the issue and be unsuccessful. <br />Attorney Vitunac was hopeful that if some major county, like <br />Dade or Broward, decides to challenge the rule, we can join in as <br />a signatory to their appeal and not have to go to Washington or <br />wherever this is. He agreed to check into both aspects and the <br />FACO and the League of Cities. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, the Board unanimously (4-0, <br />Chairman Bird being absent) agreed to support our <br />ordinance; confer with appropriate bodies that may <br />be considering litigating the matter; convey that <br />position to FEC as well as the federal government; <br />evaluate our position; and revisit this matter for <br />action in the future. <br />SOLID WASTE DISPOSAL DISTRICT <br />Vice Chairman Wheeler announced that immediately upon <br />adjournment the Board would reconvene sitting as the Commissioners <br />of the Solid Waste Disposal District.
