Tworek <br />Senior Planner, SIng ange Planning <br />DATE: August 19, 1991 <br />RE: Michael O'Haire and County Initiated Request to Rezone <br />Approximately 11± Acres From RS -3 to RS -1 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of August 27, 1991. <br />DESCRIPTION AND CONDITIONS <br />This is an owner initiated and county initiated request to rezone <br />three parcels containing approximately 11± acres from RS -3, Single - <br />Family Residential District (up to 3 units/acre) to RS -1, Single - <br />Family Residential District (up to 1 unit/acre): The property is <br />located in the 500 block of the south barrier island on the west <br />side of State Road A -1-A. Michael and Shirley O'Haire, owners of <br />the northernmost parcel of the subject property, are acting on <br />behalf of themselves and John and Nancy Luther, owners of the <br />southernmost parcel of the subject property. The middle parcel of <br />the subject property, owned by Jack and Marjorie Krovocheck, is the <br />subject of the county initiated portion of this rezoning request. <br />Initially, Mr. O'Haire approached staff with the intent of <br />submitting a rezoning request for the entire 11 acres. Staff, <br />however, informed Mr. O'Haire that,'pursuant to Section 902.12 of <br />the county's land development regulations, an individual may <br />petition for a rezoning only for property which'he owns or for <br />which he has the owner's authorization. To change the zoning on <br />property where the owner is not a party to the request, the Board <br />of County Commissioners would need to initiate the process. Mr. <br />O'Haire went before the Board to request a county -initiated <br />rezoning of the middle parcel, owned by Mr. Krovocheck. <br />At its meeting of May 21, 1991, the Board of County Commissioners <br />directed staff to consider the middle parcel as a county -initiated <br />rezoning. The Board's intent was to provide a means by which the <br />subject property could be objectively evaluated and its zoning <br />designation appropriately determined. As a result, this item will <br />be considered as one rezoning action. <br />At its regular meeting of June 27, 1991, the Planning and Zoning <br />Commission voted 4-2 to deny the request to down -zone the subject <br />property. The request was then appealed to the Board of County <br />Commissioners. <br />10 <br />
