3. Repair all distressed areas of pavement which are included in <br />two areas of distress, approximately 27' X 9' and 30' X 91. <br />4. Overlay the paved area within the 35 foot strip with 3/4 inch <br />hot asphaltic concrete surface coat. <br />5. Re -grade the northern portion into a retention swale. <br />6. Re -locate vegetation that is blocking the alignment for <br />improvement of sight distance. <br />These are minimal improvements that will not infringe upon the <br />usage of this parcel as an access. These will also enhance the <br />safety and accessibility of this strip as well as reduce <br />maintenance costs. <br />The proposed improvements' cost should not exceed $6,600.00 and <br />should serve to continue existing access and usage until a decision <br />to improve 14th Street from 6th Avenue to U.S. #1 is made by the <br />Board of County Commissioners. <br />Legal Issues: Rights of Access and Development <br />There are many complicated legal issues which could not be reduced <br />to writing due to time constraints. Listed below are several legal <br />issues that Assistant County Attorney Will Collins will present at <br />the August 27th Board meeting. <br />*Trespass <br />*Code Enforcement Board: <br />*Inverse Condemnation <br />*Prescriptive Easement <br />*Contracts <br />Summary <br />Site plan Violations <br />Access uncertainties and problems related to the 1114th Street" use <br />have plagued the County and area property owners for several years. <br />The County, through its pending acquisition of the 35' LaCava <br />strip, is.initiating steps to legalize and help control a roadway <br />which has been used by the public and has served area property <br />owners for bears. By redeveloping the former Clock Restaurant <br />site, Dependable Dodge has worked with the County to maintain a <br />safe accessway, and to address some of -the legal problems and code <br />violations referenced in this report.
