REQUEST BY MS. Davis, P.E. <br />Public Works Director <br />SUBJECT: Request by Ms. Madeline Kaye for County <br />to Close 78th Avenue between 129th Street <br />and 128th Court in Roseland <br />DATE: August 21, 1991• FILE: kaye.agn <br />DESCRIPTION AND CONDITIONS <br />During the August '6, 1991 meeting of the Board of County <br />Commissioners, Ms. Madeline Kaye, resident of 7840 128th <br />Court in Roseland, requested permission to close the public <br />right-of-way referred to as 78th Avenue between 129th Street <br />and 128th Court. Mrs. Kaye has stated that vehicles travel <br />the right-of-way where no physical road exists and disturbs <br />the peace in that area. Ms. Kaye has previously barricaded <br />the roadway without obtaining a right-of-way construction <br />permit. In addition, Ms. Kaye requested that the drainage <br />ditches in the area be cleaned. <br />ALTERNATIVES AND ANALYSIS <br />Staff has investigated this complaint and 78th Avenue is a <br />35' wide platted right-of-way. At the present time, an <br />improved roadway does not exist. <br />The right-of-way is needed for future access to unplatted <br />lands to the south, and to provide drainage in the Roseland <br />area. The barricades installed by Ms. Kaye are not standard <br />barricades,_ and the County could be exposed to liability if <br />someone collided with the structure. <br />Numerous similar requests are received from property owners <br />throughout the County for unopened right-of-ways to be <br />barricaded and the Public Works Department's policy has been <br />to only _barricade those right-of-ways where continual, <br />significant traffic problems exist. A properly designed <br />barricade that is effective could cost $2,000. <br />Certain other citizens in the Roseland area have objected to <br />the closing. <br />The following Alternatives are presented: <br />Alternative No. 1 <br />Approve the County Road and Bridge Division installing <br />standard barricades at a cost of approximately $2,000. <br />Alternative No. 2 <br />Leave the 78th Avenue right-of-way open as has existed <br />over the past 70 years. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends that the right-of-way remain open and <br />Alternative No. 2 be approved.
