_I <br />.SEP 10 1991 <br />BOOK 4 <br />roadwork until we own the right-of-way where the road is being <br />placed. <br />Discussion ensued regarding the percentage of road use which <br />is site -related and Mr. Davis felt it is 80% site -related use so <br />the County should fund 20%. <br />Commissioner Eggert asked what portion of the 27 -foot right- <br />of-way is encumbered by the turn lane. Mr. Davis estimated 60% of <br />that 27 feet will be encumbered by the turn lane. <br />Chairman Bird felt if the County has policy, it should be <br />followed. Commissioner Wheeler pointed out staff's recommendation <br />is to continue to negotiate, and Commissioner Eggert felt if the <br />use is 80% site -related, there is no need for negotiation. <br />Commissioner Scurlock preferred to have information about the <br />negotiations in writing, along with Dr. Fischer's counterproposal <br />in writing; then he would be able to make a decision. <br />Chairman Bird recognized Dr. Fischer's representatives who had <br />arrived during the discussion. <br />Attorney Warren Dill, representing Dr. Fischer and accompanied <br />by Carl Fischer, came before the Board and stated he understood <br />that the only issue before the Board was the payment for the <br />eastbound deceleration lane, or eastbound right turn lane. <br />Public Works Director Davis agreed. <br />Attorney Dill stated that turn lane certainly is an important <br />issue and there are two other issues that go along, and it may be <br />necessary to defer this discussion to a later date because of the <br />two other issues. One involves the Fleming Street extension which <br />is clearly on the City of Sebastian's comprehensive plan. It is a <br />traffic circulation element, is classified as a minor collector <br />street, and that street was put in by Dr. Fischer the entire length <br />of the project at this time at the request of the City and will be <br />dedicated to the City for their thoroughfare network. So, Dr. <br />Fischer fully expects to be able to receive an impact fee credit <br />for some of the construction costs on that road. Another issue is <br />the 27 -foot right-of-way which was discussed. Mr. Dill understood <br />that right-of-way was set aside at the request of the County and <br />that project has, in essence, been designed around the idea of <br />setting that 27 feet aside and it is to be purchased by the County <br />at this time. And the third issue involves the payment for the <br />deceleration lane. <br />Commissioner Eggert asked if the deceleration lane is part of <br />the 27 feet. <br />Mr. Dill understood, from his discussions with Randy Mosby, <br />that the percentage of the 27 -foot strip of land is not as much as <br />the Commissioners had stated. <br />18 <br />
