Commissioner Scurlock further pointed out that the budget <br />changes every year, and lights can be added or even deleted. <br />Commissioner Eggert did not believe that we can change the <br />ordinance tonight in any event and asked about our options to do <br />something for Mr. Mensing. <br />Attorney Vitunac advised that this Board actually is a board <br />of adjustment and has the power to give some relief tonight if <br />they wish to. <br />Mr. Mensing again presented his argument that the Roseland <br />road residents reap 2 benefits - the safety factor and the light, <br />and he continued to stress that the benefit is per family unit <br />and should be assessed per lot as recorded and then you could <br />have total equity. <br />Chairman Bird believed that Mr. Mensing makes some good <br />points, but noted that he would find it very difficult to vote in <br />his favor tonight because this is only one of 12 street lighting <br />districts, and staff uses the same formula for all. He would <br />not, however, object to staff looking at this during the next <br />year to see if there is a more equitable method. <br />Commissioner Wheeler asked if we have an ability to make an <br />adjustment based on Mr. Mensing's arguments without changing the <br />ordinance. <br />Attorney Vitunac stated that the Board does have the ability <br />to make that decision with Mr. Mensing but noted that it then <br />would have to be applied consistently and fairly with anyone else <br />in the same position. This would just apply to the person <br />requesting it tonight, and then you would have to give it to <br />Director Davis as an order to proceed with making a change in the <br />ordinance. <br />Chairman Bird again stated his preference just to have staff <br />look at this during the year. <br />Attorney Vitunac informed the Board that his office is <br />presently working.with Director Davis to try to unify all these <br />districts into one. <br />Discussion continued regarding the many ways to look at <br />this, and Chairman Bird determined that no one else wished to be <br />hard. He thereupon closed the public hearing on Roseland Road <br />Street Lighting District. <br />Commissioner Eggert agreed that it is kind of late to be <br />considering this, but she did agree with Mr. Mensing's point of <br />view when it comes to.lighting as opposed to drainage, and <br />Commissioner Scurlock felt this district is unique in that it has <br />a corridor as opposed to a .service area. <br />Commissioner Wheeler understood the argument but was <br />51 BOOK PPE <br />SEP i 1 99 <br />L <br />
