PUBLIC HEARING - LOITERING ORDINANCE (rescheduled from meeting_of <br />8/27/91) <br />The hour of 9:05 o'clock A.M. having passed, the Deputy <br />Clerk read the following Notice with Proof of Publication <br />attached, to wit: <br />VERO BEACH PRESS -JOURNAL <br />Published Daily <br />Vero Beach, Indian River County, Florida <br />COUNTY OF INDIAN RIVER: STATE OF FLORIDA <br />Before the undersigned authority personally appeared J. J. Schumann, Jr. who on oath <br />says that he is Business Manager of the Vero Beach Press -Journal, a daily newspaper published <br />at Vero Beach in Indian River County, Florida; that the attached copy of advertisement, being <br />a <br />in the _J Court, was pub- <br />' ., <br />lished in said newspaper in the issues of i <br />NOTICE <br />The Board of County Conurpdrsosvlloners of Indian <br />Public HRim earing <br />Floridascheduled for hereby:05 a.mm.. on Tway. <br />September 17, 1991, to discuss the following pro- <br />posed ordlrhance entified: <br />AN ORDINANCE OF INDIAN RIVER CONN- _ <br />TY, FLORIDA, MAKING R UNLAWFUL TO <br />LOITER M A PUBLIC PLACE M A MAN- <br />NER MANIFESTING THE PURPOSE OF <br />ILLEGALLY USING, POSSESSION OR <br />SELLING CONTROLLED SUBSTANCES. <br />Anyone who may wish to appeal any decision which <br />Zbe made at this meeting will need to ensure <br />that a verbatim record of the proceedings <br />which Includes -the tesltmony and upon <br />Which the appeal Is based. 828882 <br />Affiant further says that the said Vero Beach Press -Journal is a newspaper published at <br />Vero Beach, in said Indian River County, Florida, and that the said newspaper has heretofore <br />been continuously published in said Indian River County, Florida, each daily and has been <br />entered as second class mail matter at the post office in Vero Beach, in said Indian River Coun- <br />ty, Florida, for a period of one year next preceding the first publication of the attached copy of <br />advertisement; and affiant further says that he has neither paid nor promised any person, firm <br />or corporation any discount, rebate, commission or refund for the purpose of securing this <br />advertisement for publication in the said newspaper. <br />Sworn to and subscribed before me this qday of D. 19 � <br />t <br />lBtdinesS Mar(ager) <br />.d. <br />--(Fier#-ef-ttitrEl mM-eourt-India RiverCounL4 Florida) . <br />(SEAL) •. ,-,. <br />807 <br />Assistant County Attorney Terry O'Brien advised that this <br />ordinance was prepared at the request of the Sheriff's <br />Department. It reads the same as an ordinance that was recently <br />reviewed/approved by the DCA, and staff recommends adoption. <br />Chairman Bird opened the public hearing and asked -if anyone <br />wished to be heard in this matter. <br />Cheryl Ann Burke of the Substance Abuse Council spoke in <br />favor of the adoption of this ordinance. She wished to take this <br />opportunity to introduce the new president of the Council, Bob <br />SEP 1`77 1991 19 <br />
