Davis, P.E., <br />Public Works Director <br />SUBJECT: Public Hearing for Ordinance Establishing <br />the Street -Lighting Districts for <br />1) Tierra Linda Subdivision <br />_2) Walker's Glen Subdivision <br />3) Floralton Beach Subdivilsion <br />DATE: August 12, 1991 FILO: msbuord.agn <br />DESCRIPTION AND CONDITIONS <br />In the past few years. street lights were installed for three <br />subdivisions prior to the establishment of Municipal Service <br />Benefiting Units. The Board_ established funds to handle the <br />deficit each year. Attached is a copy of each yearly budget. <br />Listed below is a history of each subdivision receiving street <br />lights before establishing a MSBU District: <br />Floralton Beach <br />In 1987, the City of Vero Beach furnished street lights to both <br />Floralton Beach Subdivision and the Moorings Subdivision prior to <br />the County entering into any type of street lighting agreement. <br />In August, .1989, Indian River County received a letter from the <br />City indicating they would begin billing the County for both <br />subdivision street lights effective October 1989. Neither <br />subdivision had been budgeted to offset the cost. In January <br />1990, the Office of Budget and Management recommended that the <br />cost be paid from Traffic Engineering funds. In May 1991 the <br />County Attorney's office was directed to draft an ordinance <br />establishing the Floralton Beach Street Lighting District. <br />(attached) <br />Tierra Linda <br />In February 1987, the developer of Tierra Linda requested that <br />the County have street lighting installed thereby he would <br />dedicate all streets and right-of-ways to the County. A street <br />lighting fund was established and in 1990 the County Attorney's <br />office was directed to draft an ordinance establishing a -street <br />lighting district.(attached) <br />Walker's Glen <br />In March 1990, the developers of Walker's Glen requested that a <br />street lighting district be established. Again the Board <br />authorized the County Attorney's staff to develop all documents <br />necessary.(attached) The County Public Works staff requested the <br />lights be installed in June of 1990, the City did not start <br />charging the County for these lights until June 1991. <br />A copy of each Ordinance creating Street Lighting Districts for <br />each subdivision was sent to the Press Journal for advertisement <br />for four consecutive weeks in August and September. <br />RECOMMENDATIONS AND FUNDING <br />Subject to comments by the public at the Public Hearing, staff <br />recommends approval of the Floralton Beach Subdivision Street <br />Lighting District, Tierra Linda Subdivision Street Lighting <br />District, and Walker's Glen Subdivision Street Lighting District. <br />The first non -ad valorem assessment shall be levied for the tax <br />year 1992-1993. <br />36 <br />I I <br />
