SEP 24 `NT �,� <br />BOOK G F'�g�E d <br />AGREEMENT <br />between <br />INDIAN RIVER COUNTY, FLORIDA <br />_ and <br />CITRUS UTILITIES, INC. <br />-� Re: Water and Wastewater System Franchise <br />THIS AGREEMENT, made this 24 day of September 1991, by <br />and between <br />INDIAN RIVER COUNTY, a political subdivision of the <br />State of Florida, the address of which is 1840 25th <br />Street, Vero Beach, FL 32960 -(hereafter COUNTY) <br />and <br />CITRUS UTILITIES, INC.; a corporation existing under <br />the laws of the State of Florida, the address of which is <br />(hereafter CITRUS) <br />WITNES SETH THAT : <br />For and .in consideration of the mutual covenants and other good and <br />valuable consideration, the COUNTY and CITRUS agree as follows: <br />1. CITRUS will transfer all on-site water and sewer facilities to the <br />COUNTY pursuant to appropriate dic miaTies approved by County <br />Attorney's Office. <br />2. CITRUS will release all funds that are in the impact fee escrow. -account <br />to COUNTY. <br />3. CITRUS will convey all off-site lines (water ' and sewer) to COUNTY, <br />pursuant to appropriate documentation approved by the County <br />Attorney's Office and payment by COUNTY as follows: <br />Cost of off-site facilities $160,863 <br />Less depreciation (45,000) <br />(, <br />.Payment for off-site lines $115,8?3 <br />4. CITRUS will assign all of its water capacity in the GDU water plant to <br />COUNTY upon payment by COUNTY of $170,800 representing 70,000 <br />gallons per day capacity at GDU current rates. <br />CITRUS will pay $150,112 balance due for impact fees to COUNTY minus <br />1 any accrued interest, due to Citrus. <br />CITRUS will be free to utilize its reserve sewer capacity in the GDU <br />plants in any legal manner it deems appropriate. <br />7. COUNTY will accept the wastewater line for maintenance and ownership, <br />which is located underneath a covered parking area of Condo VIII, and <br />90 <br />
