Keatfi <br />no, A <br />Community Develo men Director <br />FROM: Stan Boling, AICP <br />Planning Director <br />DATE: October 7, 1991 <br />SUBJECT: REQUEST TO SCHEDULE A PUBLIC HEARING DATE FOR THE GRAND <br />HARBOR MARINA EXPANSION SUBSTANTIAL DEVIATION <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County'Commissioners at its regular <br />meeting of October 15, 1991.. <br />DESCRIPTION AND CONDITIONS:• <br />In September 1989, Grand Harbor applied to the Treasure Court <br />Regional Planning Council (TCRPC) for approval to amend the Grand <br />Harbor development order (D.O.). The requested amendment is to add <br />324 boatslips to the Grand Harbor marina which is currently <br />approved for 144 slips. If the request is approved, the result <br />would be a total of 468 slips in the marina. The addition of slips <br />is considered significant -and, therefore, constitutes a <br />"substantial deviation" from the approved development plans and <br />D.O. _ <br />.A substantial deviation request is reviewed and processed in much <br />the same way as the original D.R.I. project (see attachment #1). <br />The delay in the review and consideration of this substantial <br />deviation application has been at the request of the developer. <br />During 1990 and the early part of 1991, the developer requested the <br />ability to delay and extend the substantial deviation application; <br />the requests to extend the application were granted by the TCRPC <br />with no objections from county staff. The developer requested the <br />application extensions due to the ownership charges and uncertainly <br />of direction of the Grand Harbor project. <br />The substantial deviation request has now undergone a review for <br />informational and analysis content (known as the "sufficiency <br />review") by the TCRPC staff with input from county staff and state <br />and federal agencies. To date, the TCRPC staff has been <br />responsible for coordinating the review process. The TCRPC staff <br />has now officially certified that the request application is <br />sufficient for consideration and action (see attachment #2). <br />Pursuant to Florida Statutes 380.06(11), the Board of County <br />Commissioners is now required to schedule a public hearing date at <br />which the Board, after receiving a report and recommendation from <br />the TCRPC, will consider approving the request and amending the <br />development order (D.O.). <br />In addition to normal scheduling requirements, it should be noted <br />that the applicant is requesting a May,1992 hearing date to allow <br />more time to try to address a major environmental concern expressed <br />by the TCRPC staff.
