Keating, AICP 40Ak <br />Community Development Director <br />!DATE: October 15, 1991 <br />SUBJECT: ROBERT BRUCE'S REQUEST FOR MODIFICATION OF THE <br />BOUNDARY OF THE P10 UNIT OF THE COASTAL BARRIER <br />RESOURCES -SYSTEM <br />It is requested that the data herein presented be given formal <br />consideration by the board of county commissioners at their regular <br />meeting of October 22, 1991. <br />DESCRIPTION & CONDITIONS: <br />In 1982, congress enacted the Coastal Barriers Resources Act (CBRA) <br />for the purpose of establishing federal policy not to subsidize <br />future development in hazardous coastal barrier areas. As adopted, <br />the CBRA of 1982 designated 186 "undeveloped" areas or units along <br />the Atlantic and Gulf coasts which were subject to the provisions <br />of this act. While the act prohibits all federal expenditures or <br />federal assistance for development in these units, the most notable <br />effect is the prohibition of flood insurance to any new structure <br />located within these Coastal Barrier Resources System (CBRS) units. <br />Of the 186 CBRS units designated in 1982, two are located partially <br />or fully within Indian River County. The P-10 unit is located on <br />the north barrier island, while the P -10A unit is located on the <br />south barrier island. Portions of P -10A are in both Indian River <br />and St. Lucie Counties. As established in 1982, the P-10 unit <br />included the Ambersand Beach Subdivision and other areas in the <br />vicinity of Ambersand. <br />i . <br />In March of 1982, the board of county commissioners sent a letter <br />of objection to the Department .of Interior, objecting to the <br />Department's then proposed maps. Despite that letter of objection <br />and a board resolution -also objecting to the proposed maps, the P- <br />10 and P -10A units were established in Indian River County. Since <br />that time, construction has continued in Ambersand and the other <br />areas located in the P-10 unit, despite the prohibition of flood <br />insurance for new structures in these areas. <br />According to the Coastal Barriers Resources Act, the Department of <br />Interior was to submit a report to congress regarding the CBRS <br />within three years of the adoption of the Act. Released in 1987, <br />this draft report recommended a number of changes to the CBRS, <br />including a substantial expansion of the P-10 unit in Indian River <br />County. As proposed by the Department of Interior, P-10 would be <br />expanded to incorporate almost the entire unincorporated area north <br />of the boundary of the Town of Indian River Shores as well as the <br />area within the Town of Orchid. <br />28 <br />
