years has managed to sell about 15 or 16 acres a year. He <br />emphasized that he is not a developer, he is a long-time <br />investor. He has been paying taxes for 32 years and is trying to <br />survive by selling only 10 or 15 acres a year. He doesn't see a <br />boom coming to Fellsmere or see people coming in there by the <br />droves and building on those 5- acre lots. Mr. Kahn urged the <br />Board to give him back the densities he had before the new Comp <br />Plan was adopted. <br />There being no others who wished to be heard, the Board <br />closed the Public Hearing. _ <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously approved <br />the transmittal of the proposed land use amendment to <br />DCA for their 90 -day review. <br />Chairman Bird wished to enter into the record the following <br />letter received from Berry Farms expressing their concern about <br />the steady encroachment of residential land use into rural, <br />agricultural areas: <br />Richard N. Our <br />concern is the steady encroachment of residential land use <br />into rural, agricultural areas. Prospective purchasers of <br />this property should be made aware of Florida Statute 823.14 <br />the "Right to Farm Act". <br />Please register our concern by reading the following <br />^ excerpts from the statute into the record. <br />"823.14 Florida Right to Farm Act <br />(2) LEGISLATIVE FINDINGS AND PURPOSE.- The <br />�11213� <br />4 �js Legislature finds that agricultural production <br />' �6� is . .a major contributor to the economy of the <br />NOV 1991 state; that agricultural lands constitute unique <br />and irreplaceable resources of statewide importance <br />RECEIVED o .....The Legislature further finds that agricultural <br />BOARD COUNTY activities conducted on farm land in urbanizing <br />COMMIss1oNERS areas are potentially subject to lawsuits based on <br />C'^,the theory of nuisance and that these suits <br />encourage and even force the premature removal of <br />the farm land from agricultural use. •I•t is the <br />propose of this act to protect reasoriable <br />agricultural activities conducted on farm land from <br />61 E�OC�K 4 <br />
