r � <br />NOV 11-4,91 E" 6' <br />f' POOK <br />ANALYSIS: <br />As the Board of County Commissioners is aware, the City of'Sebastian* <br />has requested a revocation or cancellation of the franchise given to <br />the County to provide water and wastewater service within the city <br />limits of the City of Sebastian. The County has agreed to <br />relinquish its franchise rights within the City and on March 13, <br />1991, the County sent a letter to the City offering to relinquish <br />its franchise rights. On April 5, 1991, the City conditionally <br />accepted the County's offer subject to completion of the necessary <br />documents containing the terms and conditions acceptable to both <br />parties, so that agreements, ordinances, and resolutions may be <br />rescinded in such manner as to not impact third parties. <br />The County and City staff members have met on several occasions to <br />work out interim plans to effect the separation of the utility <br />systems and are developing the provisions of_an interlocal agreement <br />I as an acceptable way to satisfy the concerns of all parties. One <br />Provision of the interlocal agreement would be for Indian River <br />County to accept and treat wastewater generated within the <br />wastewater system owned and operated by the City of Sebastian. This <br />l provision will require the County to "Develop a nondiscriminatory, <br />cost -of -service rate to be charged to the City for treatment of the <br />iwastewater, which rate shall take into account the fact that the <br />City is utility service provider for all classes of units within the <br />City. The rates and components which make up the rates would be <br />attached and incorporated into the agreement." <br />1The Department reviewed these requirements with CH2M Hill, its rate <br />jconsultant, and requested a Scope of Services for the development of <br />hates and charges for providing wholesale wastewater service to the <br />City of Sebastian. The fee for providing the Scope of Services <br />under Work Authorization Six (attached) will be $9,640.00, with a <br />.charge of $1,490.00 for additional meetings if required. The <br />,project is to be funded from account No. 471-218-536-033.19 (other <br />;professional services - wastewater). <br />RECOMMENDATION: <br />The staff of the Department of Utility Services recommends approval <br />of the attached Work Authorization Six and authorization for the <br />Chairman of the Board of County Commissioners to execute the <br />agreement. <br />Commissioner Scurlock was concerned about an article in the <br />newspaper which reported that someone from CH2M Hill was contacted <br />by the press and hung up on the reporter. Mr. Scurlock talked to <br />the reporter and she confirmed the occurrence. He wanted to bei, <br />sure this behavior does not reflect on the County because Indian <br />River County employees and agents should be polite and courteous. <br />At the very least, the reporter could have been referred to our <br />County Administrator. <br />County Administrator Chandler agreed there is no question we <br />are supposed to be accessible and responsive to people. <br />Commissioner Scurlock felt the message would be conveyed and <br />recognized Mr. McIntyre in the audience and assumed he heard the <br />comment. <br />G -i <br />
