Collins II - Deputy County Attorney <br />DATE` _ December 11, 1991 <br />SUBJECT: Release of Nuisance Abatement Lien - Tamara Gardens Condo, <br />Inc. <br />Indian Beach Associates, Inc., through its agent, has contacted our office in <br />regard to a nuisance lien which they recently became aware of, which was <br />attached to their property on February 13, 1990; one and a half --years prior <br />to Indian Beach Associates, Inc. Is purchase of the subject property, and two <br />owners later. <br />Upon lengthy research into this matter, we have learned that the lien <br />(Resolution No. 90-21) in the amount of $2,455.17 had been recorded out of <br />the chain of title, i.e.,. the property had been sold to Paul L. Roth and <br />Monty C. Beber, as Trustees from Tamara Gardens, Inc. on November 28, <br />1989, and the County's lien was not made of record until February 13,• 1990... <br />When Indian Beach Associates, Inc. purchased the property on August 23, <br />1991, the lien was out of the chain of title and, therefore not picked up. <br />Also, to compound the problem, the lien did not reflect the accurate name of <br />j the corporation back when the violation .existed, i.e., the owner of the <br />'property was Tamara Gardens, Inc., and the lien -was filed as Tamara <br />,Gardens Condo' Inc.r <br />t.RECOMMENDATION: .a• <br />;..Authorize the Chairman of the .Board of County Commissioners to execute . the <br />;;attached --Release of Lien..; <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously <br />authorized the Chairman to execute the Release of <br />Nuisance Abatement Lien on Tamara Gardens Condo, <br />Inc., as recommended by staff. <br />COPY OF RELEASE OF LIEN IS ON FILE IN THE OFFICE OF <br />CLERK TO THE BOARD <br />L. Out -of -county Travel for Commissioners and Staff to Attend the <br />Treasure Coast Legislative Conference <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously <br />approved out -of -county travel for Commissioners and <br />Staff to attend the Treasure Coast Legislative <br />Conference in Tallahassee from February 3 to 5, <br />1992. <br />14 <br />
