O'Brien - Assistant County Attorney yPO <br />DATE: December 9, 1991 <br />RE:' PUBLIC HEARING - 12/17/91 - CHAPTER 302 <br />ORDINANCE ADDING ANIMAL CONTROL AND KENNEL <br />REGULATIONS <br />The attached ordinance has been prepared in connection with the <br />ongoing revision of the Indian River County Code (1974 edition). The <br />Board of County Commissioners has previously authorized the <br />advertising of this ordinance for a public hearing on December -17,- <br />1991. <br />Staff recommends approval of the attached proposed ordinaaco. - - <br />Attorney O'Brien noted a correction would be made on page 18 <br />of Attachment A. <br />Commissioner Bowman requested and Attorney O'Brien agreed to <br />strike the word "dumb" and substitute "lacking the power of speech" <br />in the definition of Animal. <br />Commissioner Bowman led discussion regarding notice to owner <br />before an animal is destroyed. Emergency Services Director Doug <br />Wright assured the Board that every effort is made to -contact the <br />owner before any action is taken, but the humane '-society has <br />limited facilities and there must be some time limit. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, the Board unanimously adopted <br />Ordinance 91-51, adding a new chapter 302, Animal <br />Control and Kennel Regulations, with the definition <br />of "Animal" to be "any living creature lacking the <br />power of speech." <br />ORDINANCE 91-51, IN ITS ENTIRETY WITH ATTACHMENT '-A", IS ON FILE <br />IN THE OFFICE OF CLERK TO THE BOARD <br />X11 <br />
