Chairman Eggert stated she had received a letter from Alan <br />Campbell, Economic Development Director of the Indian River County <br />Council of 100, urging approval of this request. <br />Commissioner Scurlock led discussion regarding this area of <br />the County and the fact that growth in the area near the <br />intersection of 99th Street and U.S. 1 is going to become a problem <br />if we do not address turning lanes and traffic lights. <br />Director Keating stated that the issue of that intersection <br />was addressed in the site plan for this project. In 1987 when a <br />warehouse building was approved and was constructed, one of the <br />conditions imposed upon the site plan was that before a certificate <br />of occupancy could be issued for that site, a northbound left turn <br />lane on U.S. 1 at 99th Street would have to be installed. It did <br />not say that the applicant had to put it in, but it had to be there <br />before a CO. Mr. Keating was sure that was the reason the CO was <br />never obtained. He further advised the Board that this rezoning <br />would have no effect on that requirement. <br />Chairman Eggert asked whether Florida Department of <br />Transportation has been contacted. <br />Public Works Director Jim Davis reported that Public Works <br />staff has communicated with DOT on a number of occasions requesting <br />that the northbound left turn lane be included in the median <br />revision project along North U.S. 1. The response from DOT has <br />been negative. Due to financial considerations they did not want <br />to include it. That project has not gone to bid and has not been <br />constructed and we are still encouraging DOT to consider a <br />northbound left turn lane. Mr. Davis further reported that a crew <br />is currently at that location surveying the right-of-way and plans <br />to design it. That decision was made after the fast -lube and mini - <br />warehouse facility was approved and they agreed to escrow $3,000 <br />toward the project. <br />Commissioner Scurlock asked how long it would be to complete <br />the improvement. <br />Director Davis estimated that with surveying and design work, <br />with the current progress being made on the project, it might be <br />six months. If the developer completes his work prior to stafffs <br />timing on getting the improvement completed, then we will drop our <br />project. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Wheeler, to authorize Indian River <br />County to proceed with the design improvements for a <br />left turn lane on North U.S. 1 at 99th Street. <br />34 <br />
