The Board reviewed the following memo dated 1/16/92: <br />TO: James Chandler DATE: January 16, 1992 <br />County Administrator <br />DIVISION HEAD CONCURRENCE: <br />obs M. a ti g, mcp <br />Community Developmefit Director <br />FROM: Stan Boling AICP <br />Planning Director <br />SUBJECT: Proposed Minor Amendment to the Harbor Town Center DRI <br />Development Order <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of January 28, 1992. <br />BACKGROUND: <br />On March 28, 1989, the Board of County Commissioners adopted a <br />development order (D.O.) approving the development of regional <br />impact (DRI) project known as the Harbor Town Center regional mall. <br />Subsequently, on September 26, 19891 some minor amendments to the <br />D.O. were adopted by the Board of County Commissioners. The <br />amended D.O. remains in effect. <br />The project site consists of ±92.5 acres located on the east side <br />Of U.S. #1 between 53rd Street and the Main Relief Canal (see <br />attachment #1). The proposed project includes approximately <br />747,000 square feet of gross retail commercial mall and outparcel <br />building area. The proposed project has the appropriate commercial <br />land use designation and commercial zoning, and has a valid, <br />effective D.O. Thus, the next step in the Harbor Town Center mall <br />development process is the submission and approval of.a site plan. <br />However, no site plan application has been submitted to date, and <br />no project construction has taken place. <br />REQUESTED AMENDMENT AND REQUIRED ACTION: <br />The D.O. contains many sections dealing with a variety of issues <br />and impacts. Among the issues addressed are project construction <br />commencement deadlines. One of the construction commencement <br />deadlines requires that project construction (either the mall <br />building itself or certain outparcel development) begin by March <br />28, 1992. Due to delays in the construction of Indian River <br />Boulevard which is crucial to the project, and other factors, the <br />current project developer (Petrie-Dierman-Kuhn, Inc.) is requesting <br />that the March 28, 1992 commencement deadline be deleted from the <br />D.O. (see attachment #2). <br />Pursuant to FS 380.06 which governs DRIB, the county may determine <br />that the request does not constitute a substantial deviation and <br />may be treated as a "minor amendment". As a minor amendment, a <br />change in an. approved D.O. can be made by the Board of County <br />Commissioners without formal Regional Planning Council action. <br />Pursuant to LDR section 916.05(1), the Planning and Zoning <br />Commission has considered the request.
