We are not sure we can do that yet, but we will look into it <br />further. <br />DEED TO OLD LIBRARY AND DISCUSSION OF PROPOSED ORDINANCE PLACING <br />RESTRICTIONS ON THE PROCEEDS FROM THE FUTURE SALE OF THE OLD <br />LIBRARY SITE <br />The Board reviewed the following memo dated 1/30/92: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien - Assistant County Attorney <br />DATE: January 30, 1992 <br />RE: DEED TO OLD LIBRARY <br />The City of Vero Beach by quit -claim deed of April 19, 1988 deeded its <br />interest in the old library site across from City Hall to the County. <br />The deed contained certain restrictions in the form of a condition <br />subsequent. <br />The first restriction requires the new library to be completed by April <br />5, 1995. The remaining restriction requires that any money received <br />from the sale of the quit -claimed property "be used for books and <br />internal requirements." If the County fails "to fulfill the requirements <br />of this condition subsequent" the County "shall immediately reconvey <br />said property." <br />If the new library were not completed by April 5, 1995 a reconveyance <br />could be effected. If the old library was sold and the proceeds used <br />for a purpose other "than books and internal requirements," a re- <br />conveyance would not be possible by the County as it would have no <br />interest in the property to convey. <br />In view of the foregoing and in order to remove any cloud on the title, <br />I brought this matter to the attention of the City Attorney. The City <br />of Vero Beach has executed a quit -claim deed which removes the <br />restrictions. <br />It is recommended that the Board of County Commissioners accept the <br />new quit -claim deed and have said deed recorded. <br />Attorney Vitunac recounted that Director of General Services <br />Sonny Dean was charged with disposing of certain county buildings <br />awhile ago and one of his options was selling the old library. It <br />was brought to the attention of Assistant County Attorney Terry <br />O'Brien that it would be virtually impossible to sell that building <br />with the restriction on it that would insure that the money from <br />the building would go to books and not concrete, and since the <br />building could never be sold because of the restrictions, the <br />purpose of the restriction would never be effectuated.
