1985 meeting, the Planning and Zoning Commission, based upon <br />further staff analysis and input from node workshops held in 1983 <br />and 1984, recommended adoption of new neighborhood commercial node. <br />criteria which included the following restrictions: <br />No node could exceed six (6) acres in size; and <br />No node could be established within one mile (5,2801) of <br />another neighborhood commercial node, other commercial or <br />industrial node or an MBD (mixed use) area. This <br />separation distance could be reduced by 10% to 4,752' via <br />a special waiver granted by the community development <br />director (based upon special characteristics and <br />criteria). <br />The 7.26 acre parcel involved in the neighborhood node/rezoning <br />request did not meet either of these recommended criteria. [It <br />should be noted that these criteria were ultimately adopted by <br />ordinance by the Board of County Commissioners on June 5, 1985. <br />The effective date of that ordinance was June 17, 1985.] <br />Because the 7.26 acre proposal did not meet the recommended <br />criteria, the Planning and Zoning Commission denied the ACTS <br />request at the April 25th meeting. ACTS then appealed the Planning <br />and Zoning Commission's denial to the Board of County <br />Commissioners. On June 12, 1985, the Board approved a neighborhood <br />commercial node designation covering three (3) acres of the subject <br />property, and also rezoned the three acres from RM -8, to C -1A. <br />Although the approval was not consistent with the new neighborhood <br />node criteria (specifically the separation distance requirement) <br />adopted June 5, 1985, the new criteria did not become effective <br />until June 17, 1985. Subsequently, the county adopted new zoning <br />district requirements, including a new neighborhood commercial (CN) <br />district; later in 1985, the three acre site was assigned a CN <br />district designation during the county's administrative rezoning <br />process. (See attachment #4 for a chronology of events.) This <br />three acre site is the subject property now owned by Paul V. and <br />Denise E. Minotty. <br />In 1988, David Robinson, acting on behalf of Arthur Newton, <br />submitted a major site plan application to construct a 21,856 sq. <br />ft. retail complex on this site (SP -MA -88-10-77). A site plan for <br />the subject property was approved in 1989. The applicant did not <br />satisfy all the conditions set forth as part of the site plan <br />approval, and, therefore, the site plan was never released. The <br />site plan expired on August 24, 1990. Consequently, no building <br />permit has been issued, no construction has commenced, and <br />currently there is no active approved site plan to develop the <br />site. <br />Transportation <br />The subject property has access from 74th Avenue and State Road 60. <br />Currently, 74th Avenue is classified as a collector road on the <br />future roadway thoroughfare plan map. This segment of 74th Avenue <br />is a two-lane paved road with approximately eighty (80) feet of <br />existing public road right-of-way. State Road 60, a four -lane <br />divided roadway, is classified as an urban principal arterial road <br />with approximately one hundred sixty (160) feet of existing public <br />road right-of-way. <br />Utilities and Services <br />The site is within <br />is located in the <br />County Wastewater <br />is not built, this <br />The dividing line <br />areas for this az <br />the Urban Service Area.
