Vitunac, County Attorney <br />DATE: February 12, 1992 <br />RE: FUTURE SALE OF OLD LIBRARY <br />The attached ordinance would place a restriction on the use of any <br />funds which might be realized by the County on any future sale of the <br />old library site. The restriction parallels one put on the deed to the <br />library from the City; however, because of a title problem caused by <br />the restriction, the City released the restriction and quitclaimed the <br />property to the County free and clear. The County accepted this <br />quitclaim deed on February 11, 1992. <br />If the County adopts this ordinance, any proceeds would be used for <br />only books, furniture, and equipment for the new library system. <br />Future County Commissioners would have the power to repeal the <br />ordinance and use the proceeds for any legal purpose. <br />RECONNOMED ACTION: <br />Adopt ordinance and authorize the Chairman to execute it. <br />Chairman Eggert recommended removing the word "new" from the <br />phrase "new library system" because "new" may have a different <br />meaning in the future. <br />Commissioner Bird asked if we need to be specific as to books, <br />furniture and equipment because there may be a need for another <br />site. <br />Chairman Eggert explained that the intent is to specify that <br />these funds are not to be used for construction and site. It also <br />expands the use of these funds for library purposes beyond the main <br />library, so she felt it was necessary to include this language. <br />The Chairman, opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, she closed <br />the public hearing. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Scurlock, the Board unanimously adopted <br />Ordinance 92-07, as amended, placing restrictions on <br />the proceeds from the sale of the old library site, <br />as recommended by staff. <br />57 <br />boor. <br />
