I esti , A <br />Community Development/Director <br />-120P <br />FROM: Roland DeBloissw-AICP <br />Chief, Environmental Planning <br />DATE: March 30, 1992 <br />RE: Revisions to the SJRWMD Interlocal <br />Agreement for SWIM Grant Funding <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 7, 1992. <br />DESCRIPTION AND CONDITIONS <br />At their regular meeting on March 24, 1992, the Board of County <br />Commissioners authorized the execution of an interlocal agreement <br />with the St. Johns River Water Management District (SJRWMD) for <br />cost share funding under the state's Surface Water Improvement and <br />Management (SWIM) program. The funding pertains to two projects <br />recommended by the Marine Advisory/Narrows Watershed Action <br />Committee (MANWAC) that entail vegetation enhancement on Ski Island <br />(a.k.a. Boat Club Island) and along the Indian River lagoon <br />shoreline of Live Oak Drive. <br />According to SJRWMD staff, the District governing board must <br />approve the referenced agreement by April 7, 1992 to ensure receipt <br />of state SWIM funds. To accommodate that schedule, county staff <br />scheduled and obtained Board of County Commissioners' approval of <br />the agreement at its March 24th meeting. The agreement presented <br />to the Board at that time was drafted by SJRWMD staff. <br />Now, subsequent to County Commission approval, SJRWMD legal staff <br />are requiring modifications to wording in the contract agreement. <br />While the changes are minor, any changes to the contract require <br />Board approval. <br />As such, this matter is being brought back to the Board for <br />authorization to execute the revised contract with minor <br />modifications required by SJRWMD. <br />ALTERNATIVES & ANALYSIS <br />The minor revisions to the contract are as follows:' <br />Page 5, Paragraph "D": "The COUNTY agrees that acceptance of the <br />final payment, shall be considered as a release in full of all <br />claims against the DISTRICT or any of its members, agents, and <br />employees, arising out of, or by reason of, the work done and <br />materials furnished under this AGREEMENT.
