I e i, IC <br />Community Develop�ment irector <br />FROM: Roland DeBlois;'1ICP <br />Chief, Environmental Planning <br />& Code Enforcement Section <br />DATE: April 13, 1992 <br />SUBJECT: Request to Amend County Code Chapter 103, <br />Creating Code Enforcement Citation Procedures <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 21, 1992. <br />DESCRIPTION & CONDITIONS <br />This is a request to amend Chapter 103 of the County Code, to <br />establish a citation process for the enforcement of county <br />ordinances and contractor licensing regulations. Just as with a <br />traffic ticket, a code enforcement citation would constitute a fine <br />imposed upon the respondent. The respondent could opt to pay the <br />fine or contest the charge. <br />Since 1983, Indian River County has conducted code enforcement <br />activities pursuant to Chapter 162, Florida Statutes, which enables <br />local governments to establish code enforcement boards. Chapter <br />162, F.S. sets forth specific guidelines regarding code enforcement <br />board procedures. <br />Recently, the Florida Statutes were amended to allow another <br />enforcement option. Chapter 162, F.S. now allows local governments <br />to establish citation procedures for the enforcement of general <br />county codes. In addition, Chapter 489, F.S. enables local <br />governments to establish citation procedures specific to building <br />contractor violations. <br />At their regular meeting on March 10, 1992, the Board of County <br />Commissioners authorized staff to advertise for a public hearing at <br />which the Board would consider the adoption of a county citation <br />ordinance. Since the citation ordinance will be created by <br />amending Chapter 103 of the County Code, the Board must consider an <br />amendment to this chapter to establish citation authority for the <br />county's code enforcement staff. <br />As an amendment to a part of the County Code which is not a "land <br />development regulation" per se, this proposed amendment to Chapter <br />103 was not reviewed by the Planning and Zoning Commission. The <br />staff, however, did hold a public workshop on the matter on March <br />27, 1992. In addition, staff presented the proposed ordinance to <br />the Professional Services Advisory Committee (PSAC) at their <br />meeting of April 9, 1992. The PSAC suggested several minor changes <br />(which have been incorporated in the present draft) and indicated <br />their support for the proposed ordinance. <br />W <br />we, <br />
