M <br />An application for the certificate has been submitted by the Town. <br />Staff has reviewed the application and certifies that all <br />requirements of Chapter 6:50 of the County Code has been met which <br />would justify the issuance of the referenced certificate. <br />The service area for this EMS ALS provider would be confined to the <br />municipal limits of the Town of Indian River Shores, except when <br />assistance is requested in a mutual aid situation. <br />ALTERNATIVES AND ANALYSIS <br />The County Code provides for routine renewal of the EMS Certificate <br />of Public Convenience and Necessity on application by -a current <br />certificate holder. This can be accomplished without a public <br />hearing if the board has no reason to believe that the public <br />health, safety, and welfare would be at risk. Staff submits that <br />there is no reason to hold a public hearing and absent that <br />requirement, staff requests the Board renew and issue the new <br />certificate for the Town routinely. <br />RECOMMENDATION: <br />Staff respectfully recommends that the Board of County <br />Commissioners approve and renew the EMS ALS Certificate of Public <br />Convenience and Necessity for the Town of Indian River Shores <br />Department of Public Safety to be effective for a period of two <br />years. <br />This provider, as with all others, will continue to be subject to <br />the authority of the state statutes, administrative rules, and <br />County EMS Director as provided by Chapter 6.50 of the Indian River <br />County Code of Laws and Ordinances. <br />In answer to Chairman Eggert's question, Director of Emergency <br />Services Doug Wright confirmed that Indian River Shores would <br />remain subject to our ordinances. They would not be under our <br />control, but they would have to adhere to our ordinances in terms <br />of response time, etc. <br />Chairman Eggert had a problem with somebody running under <br />their own control when the County could be liable for what they do. <br />Attorney Vitunac explained that we are liable to see that <br />anyone having a certificate in our county lives up to the County <br />ordinances and State regulations. Director Wright just will not do <br />the day to day oversight of their operations. <br />Director Wright added that the State will do the inspections. <br />We will pull from the 911 data base from time to time to check on <br />their average response time and other things. <br />57 <br />�.t !" <br />APR T �ooK U F„,� o <br />
