r- <br />-MAY 051 <br />BOOK 8 F,;E •� -- <br />Community Development Director Robert Keating advised that in <br />their 90 -day review of the proposed changes, DCA had the most <br />problem with the change of making adjustments to node boundaries <br />without going through the Comp Plan amendment process. He didn't <br />think that had a chance of flying, but we have worked out a <br />negotiated settlement with the DCA whereby we are amending that <br />specific policy to refer to the adjustments as interpretations and <br />to indicate certain conditions where the node boundary is <br />interpreted where property may go out as well as come into the <br />node. We have made that one policy change. Director Keating noted <br />that one of two important changes relating to utilities is the one <br />recommended by the Professional Services Advisory Committee whereby <br />the utility connection matrix be changed from square footage to <br />gallonage. The other change relates to water and sewer outside the <br />urban service area to service cluster types of developments. <br />Director Keating stated that basically staff feels that all of <br />DCA -1s objections and comments have been adequately addressed. With <br />that, staff recommends approval. <br />Chairman Eggert wanted to be sure, in terms of total developed <br />acreage, that counting that land in at Humana Hospital in Sebastian <br />is covered under the way the proposed ordinance is worded, and <br />Director Keating confirmed that the revised definitions have both <br />total node acreage and developed acreage and adequately address the <br />issues that we had before. <br />Commissioner Scurlock was concerned about Policies 5.9 and 6.1 <br />in Sanitary Sewer Sub -Element and the Potable Water Sub -Element. <br />He emphasized that Indian River County has pursued a policy that <br />says the provider of utilities in this county will be the County <br />and he has a concern that these two particular conditions are not <br />specific enough and that they allow package systems. It seemed to <br />him that this is inconsistent with the past number of years and <br />that this would be opening Pandora's Box again to private little <br />package plants, and we all know the history of that. <br />Director Keating stated that it is understanding that the <br />changes to policies 5.9 and 6.1 allow the extension of County <br />service lines outside the urban service areas if it is a <br />clustering. It also would allow the package treatment plants <br />pursuant to franchise agreements that would be developed by the <br />Utilities Department. <br />Commissioner Bird asked if that would be a satellite operation <br />to the primary operation, and Commissioner Scurlock responded that <br />he didn't believe there is any real clarity to this example. <br />Director Keating explained that it was staff's position that -- <br />we would not have all the specificity in the Comp Plan, because it <br />130 <br />
