May 27, to receive feedback from the general public, and that this <br />matter will be brought back to the Board on May 26 at their regular <br />meeting. <br />Commissioner Scurlock understood there is no need to make an <br />absolute final recommendation until we get as much input as we can <br />get, and Mr. Rose commented that is precisely what they have been <br />trying to do and they do not want to rush the county into anything. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously deferred <br />this matter back to MANWAC for recommendation and <br />scheduled a public discussion item for the regular <br />BCC meeting of May 26, 1992. <br />Commissioner Bird felt we certainly don't want to depend on <br />any public hearings before the Governor and Cabinet as being an <br />opportunity to get anything changed, because experience has shown <br />that is not the thing to do. He stressed that it would be better <br />to handle it on a local basis first before it gets to the Governor <br />and Cabinet. <br />CONTRACT FOR SPECIAL APPOINTED PUBLIC DEFENDER <br />The Board reviewed the following memo dated 4/27/92: <br />TO: Board of County Commissioners <br />FROM: Sharon Phillips Brennan - Assistant County Attorney <br />DATE: April 27, 1992 <br />SUBJECT: CONTRACT FOR SPECIAL APPOINTED PUBLIC <br />DEFENDER IN NON -CAPITAL FELONY, MISDEMEANOR, <br />AND JUVENILE CASES WHERE THE COUNTY IS <br />STATUTORILY REQUIRED TO PROVIDED FOR <br />COURT-APPOINTED COUNSEL <br />On April 2, 1992, a committee comprised of Commissioner Gary Wheeler, <br />County Attorney Charles Vitunac, Circuit Judge Paul Kanarek and <br />Public Defender Phillip Yacucci met and reviewed the draft request for <br />proposals and agreement which were submitted to this Board for <br />discussion on February 25th. <br />The committee recommended changes concerning investigative fees and <br />other case -related costs and changed the definition of "case". <br />This agreement, incorporating the committee's changes, is recommended <br />by the committee for the Board's approval and for authorization to <br />request proposals from local attorneys interested in contracting with the <br />county to provide special appointed public defender services. <br />19 <br />MAY 0 6 121 BOOK bbF ,r i <br />
