The Board reviewed the following memo dated 4/27/92: <br />TO: James Chandler <br />County Administrator <br />DIV ION HEAD CONCURRENCE <br />r, 0-2 e -2 �_ V_W__ /0, .00 _. & - <br />Robert Rea n ��11, AICP <br />THROUGH: Sasan Rohani .5 ,k. <br />Chief, Long -Ran a Planning <br />FROM: Cheryl Tworek <br />Senior Planne ng -Range Planning <br />DATE: April 27, 1992 <br />SUBJECT: Feldman Request to Amend the Comprehensive Plan to <br />Redesignate Approximately 40 Acres from AG -1 to R, to <br />expand the Urban Service Area boundary to include an <br />additional ±40 Acres, and to Rezone approximately 40 <br />acres from RFD to RS -1 (LURA -91-07-0126) <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of*May 5, 1992. <br />DESCRIPTION AND CONDITIONS <br />This is a request to amend the Comprehensive Plan and rezone <br />property. The subject property is located on 58th Avenue, between <br />4th Street and lot Street, and is presently owned by David and <br />Princess Feldman. The land consists of 40 acres. <br />The request involves changing the land use designation for ±40 <br />acres from AG -1, Agriculture (up to 1 unit/5 acres) to Rural <br />Residential -(up to 1 unit/acre), rezoning 40 acres from RFD, Rural <br />Fringe District (up to 1 unit/2.5 acres) to RS -1, Single -Family <br />Residential District (up to 1 unit/acre), and extending the urban <br />service area west of 58th Avenue to the subject property's west <br />boundary. The applicants intend to develop the property with <br />residential uses. <br />On September 26, 1991, the Planning and Zoning Commission, acting <br />as the Local Planning Agency, conducted a public hearing for the <br />Purpose of making a recommendation to the Board of County <br />Commissioners regarding this request. At that meeting, the <br />Planning and Zoning Commission voted 4-2 to recommend the <br />transmittal of the proposed land -use amendment request. <br />On November 12, 1991, the Board of County Commissioners voted 5 to <br />0 to transmit the above referenced land use amendment to the <br />Florida Department of Community Affairs (DCA), and announced their <br />intention to hold a final public hearing concerning this amendment. <br />- DCA Objections <br />Planning staff received DCA's Objections, Recommendations and <br />Comments (ORC) Report on March 9, 1992. For this proposed <br />amendment, the DCA ORC report contained several substantive <br />objections. Identified as inconsistencies with state law (9J-5. <br />FAC and 163, F -S.), with the state comprehensive plan, and with the <br />comprehensive regional plan, these objections focused <br />the premature development of agriculturally designated <br />on <br />the proliferation of urban sprawl. gnated lands and <br />63 <br />II <br />
