Original <br />AGREEMENT TO PURCHASE AND SELL REAL ESTATE <br />BETWEEN INDIAN RIVER COUNTY <br />AND <br />AUDREY GRAVES SEXTON, AS TRUSTEE OF THE AUDREY GRAVES <br />SEXTON TRUST U/A/D MAY 31, 2005 <br />THIS AGREEMENT TO PURCHASE AND SELL :REAL ESTATE ("Agreement") is <br />Made and entered into as of the craybf September, 2015, byand between Indian:RiVer <br />County, a political subdivision at -t -c State of Florida- (the County"), and Audrey Graves <br />Sexton, as Trustee of the Audrey Graves Sexton Trust U/A/D May 3t, 2005, Who agree as <br />follows: <br />WHEREAS, Audrey Graves. Sexton, as Trustee OWns a 19.84 acre parcel of <br />property Iodated east of 66th Avenue and 9th Street SW, Vero Beach, Florida. A sketch and <br />legal description of the property showing the proposed :right-of-way to be purdhaSed, is <br />attach'ed to this agreement as Exhibit "A" and incorporated by reference herein; and <br />!WHEREAS, Audrey Graves Sexton is the Trustee of the Audrey Graves Sexton <br />Trust Ll/A/D May 31, 2005; and <br />WHEREAS, the County is scheduled to expand the intersection of 66th Avenue and <br />9th StreetSW in the futureand:the road: expansion will impact the Audrey Graves Sexton. <br />Trust property; and <br />WHEREAS, irr Orderforthe Couhtyto prodeed. with its road:intersection expansion <br />plans, the County needs to purchase property to be used as right-of-way from the Audrey <br />Graves Sexton Trust; and <br />WHEREAS, after negotiations with the County; The Audrey Graves :Sexton Trust <br />has agreed to sell to the CbUnty-the_needed right-of-way of approximately 55;508 square <br />feet or 1:27 acres of property as depicted on Exhibit "A", referred to as the Property; and <br />WHEREAS, The Audrey Graves Sexton Trust and the County Wish enter into this <br />agreement for the purdhase_of the Property; <br />NOW, THEREFORE, in consideration .of the mutual terms, conditions, pthmises, <br />covenants and premises hereinafter, the County and The Audrey Graves Sexton Trust <br />agree t f011OWS: <br />1.
