INDIAN RIVER COUNTY MEMORANDUM <br />TO Joseph A. Baird, County Administrator <br />I <br />THRU: Christopher R. Mora, P.E., Public Works Director <br />FROM: Monique Filipiak, Land Acquisition Specialist <br />SUBJECT: Lease Extension, Mermaid Car Wash, 1935 431d Avenue <br />431 Avenue/SR60 Intersection Widening and Improvements <br />Timothy E. Tynes and Joshana Tynes <br />DATE: April 5, 2016 <br />DESCRIPTION AND CONDITIONS <br />The; County purchased the Mermaid Carwash, located at 1935 43rd Avenue and <br />previously owned by Timothy E. and Joshana Tynes, in December 2008. The property <br />consists of a 0.47 acre lot with a 2 bay automatic carwash and 3 self-service wash bays <br />with covered vacuum area. The facility was built in 1984. As part of the consideration <br />for the purchase of the property, the County leased the property back to the Tynes <br />between March 1, 2009 and March 31, 2010 for the amount of one dollar per month. <br />After the County purchased the property in 2008, the 43rd widening project was <br />significantly delayed due to design, right-of-way and funding issues. The current County <br />work program shows construction scheduled for 2018 or later. <br />After the original 1 -year lease (@ $1 per month) expired in 2010, staff negotiated a new <br />lease for $1,750/month and the Tynes have continued to operate the car wash since that <br />time. Every year since 2010, the Tynes have renewed the $1,750.00 per month lease <br />and they would like to renew it once again in 2016, with an effective date of May 1, 2016 <br />and an expiration date of April 30, 2017. As previously stipulated, the monthly rent <br />($1,750) is due in advance on the 1St day of the month, and either party may terminate <br />the lease with 60 days written notice. <br />ALTERNATIVES AND ANALYSIS <br />1. Grant the 12 -month extension of lease. <br />2. Reject the request and issue notice to vacate. <br />FUNDING <br />None <br />RECOMMENDATION <br />Staff; recommends Alternative No. 1 by which the Board of County Commissioners <br />approves and authorizes the Chairman to execute the agreement to extend the lease <br />until April 30, 2017. <br />OQ <br />
