ORDINANCE 2016- <br />(c): Vacation rental local regulations are as follows: <br />1. Parking and storage of vehicles shall conform to the requirements of <br />zoning code section 911.15(4)(b). <br />2. Commercial events shall be prohibited in accordance with zoning code <br />section 911.15(8). <br />3. The overnight total maximum sleeping occupancy of adults (18 years or <br />older) at a vacation rental unit shall not exceed two (2) per bedroom plus <br />two (2) additional adults. The unit occupancy limit confirmed by the <br />county code enforcement officer shall be stated on the local license. <br />4. Fire protection items required for a state vacation rental license shall be <br />provided in the vacation rental unit. <br />a. In addition, a carbon monoxide (CO) alarm, when required under <br />Section R315, Carbon Monoxide Alarms of the Florida Building Code <br />— Residential, shall be provided. <br />5. Changes in the vacation rental manager and/or changes in the manager <br />contact information shall be provided to the community development <br />department within ten (10) days of the change. <br />6. The local license number, and the occupancy limit confirmed by the <br />county code enforcement officer, shall appear or be stated in any vacation <br />rental unit advertisement or any rental offering associated with a vacation <br />rental unit. <br />SECTION #2: SEVERABILITY <br />If any clause, section or provision of this Ordinance shall be declared by a court of competent <br />jurisdiction to be unconstitutional or invalid for any cause or reason, the same shall be eliminated <br />from this Ordinance and the remaining portion of this Ordinance shall be in full force and effect <br />and be as valid as if such invalid portion thereof had not been incorporated therein. <br />SECTION #3: REPEAL OF CONFLICTING ORDINANCES <br />The provisions of any other Indian River County ordinance that are inconsistent or in conflict <br />with the provisions of this Ordinance are repealed to the extent of such inconsistency or conflict. <br />SECTION #4: INCLUSION IN THE CODE OF LAWS AND ORDINANCES <br />The provisions of this Ordinance shall become and be made a part of the Code of Laws and <br />Ordinances of Indian River County, Florida. The sections of the Ordinance may be renumbered <br />or relettered to accomplish such, and the word "ordinance" may be changed to "section", <br />"article", 'or any other appropriate word. <br />SECTION #5: EFFECTIVE DATE <br />This Ordinance shall take effect upon filing with the Department of State. <br />This ordinance was advertised in the Press -Journal on the day of , 2016, for a <br />public hearing to be held on the day of , 2016, at which time it was <br />Attachment 6 <br />M-\AGENDA\Current Year\2016\Recommended Vacation Rental Ordiance - attach 6 041216 BCC.docx 3 169 <br />
