notice to the County and shall be entitled thereafter to a refund <br />of all rents paid by cash or check to County but unearned, on a <br />daily pro-rata basis, and vithout penalty for early termination. <br />In the event this License Agreement is terminated by either party <br />Prior to the expiration of the term not forth herein, Licensee <br />shall not be entitled to any refund for costs of capital <br />improvements made pursuant to this License Agreement which were <br />intended to be credited toward rental payments. <br />5. <br />Licensee agrees to carry at his expanse liability <br />insurance to protect the interests of both the County and <br />Licanaae against loss or damage by reason of personal injury, <br />los■ of life, or damage to property, in amounts not lass than <br />$100,000.00 for injuries to or death or any one person, and <br />$300,000.00 for any one occurrence, and $50,00o,00. for damages <br />to Property. Said policy or policies will be standard, owner's, <br />landlord's and tenant's policies, and will include the county as <br />an additional insured. The original or a duplicate of such <br />policy shall be made available to the County prior to use of the <br />Property hereunder. The County shall not be responsible for any <br />negligent act or omission of the Licensee on the property, or in <br />connection with the business operated by Licensee adjacent <br />thereto, and Licenses shall indemnify, defend, and bold the <br />County harmless from any claims, judgments, liens, damages, <br />liability, or any cause of action whatsoever that may arise out <br />of, or result from, the improvement, occupancy, or use of the <br />property by Licensee. <br />6. TAKS <br />Licensee agrees to pay'any and all real property <br />taxes which may accrue against the property during the term of <br />this License Agreement in the event said property is datersined <br />to be taxable due to its proposed use. <br />7.
