ORDINANCE 72-9 <br />AMENDMENT TO INDIAN RIVER COUNTY ORDINANCE NO. 71-3 <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, that Section 25 of Indian River <br />County Ordinance No. 71 - 3 is hereby amended on an emergency <br />basis by a unanimous vote of the Commission by adding the <br />following Paragraph R: <br />R. EXCAVATIONS. <br />Any excavation in excess of 100 cubic yards, <br />except those made on a building site in connection <br />with construction of a building or swimming pool <br />for which a building permit has been issued, are <br />hereby prohibited without a permit therefor first <br />issued by the Indian River County Administrator. <br />Applications for permits to excavate fish ponds must <br />be approved by the U.S.D.A. Soil Conservation Service <br />before the permit will be issued. fish ponds must <br />be set back at least 50' from any property line. The <br />50' is measured from the top of the slope. Removal <br />off the site or sale of more than 1000 cubic yards is <br />hereby declared -c be a mining operation and is pro- <br />hibited without first obtaining a mining permit from <br />the Indian River County Administrator in accordance <br />with Section h (B) (2) of this Ordinance. <br />This Ordinance shall be effective on November 22, 1972. <br />
