Dylan Remgold, County attorney <br />William K DeBraal, Deputy County attorney <br />Kate Pingolt Cotner, Assistant County attorney <br />CONSENT: 5/10/16 <br />Of ce of <br />01 <br />INDIAN RIVER COUNTY <br />MEMORANDUM <br />TO: The Board of County Commissioners <br />FROM: Dylan Reingold - County Attorney �✓ <br />DATE: May 2, 2016 <br />ATTORNEY <br />SUBJECT: Wild Turkey Sand Mine — Third Phase <br />Cash Deposit and Escrow Agreements for Compliance and <br />Restoration <br />In 2009 the Planning and Zoning Commission approved the request for major <br />site plan and administrative permit use approval for a sand/coquina mine known <br />as Wild Turkey; and both compliance and restoration security in the form of cash <br />were posted for Phase 1. Phase 1 was restored and, in June of 2015, the <br />posted funds were transferred to the second phase. The second phase has now <br />been restored to the satisfaction of the County based on site inspection, and the <br />developer is ready to proceed to the third phase and wishes to transfer those <br />funds presently in escrow with the County from the second phase to its third <br />phase. <br />Attached for your approval are both the compliance and restoration Cash <br />Deposit and Escrow Agreements for the third phase - the compliance security is <br />in the amount of $49,800.00; and the restoration security is in the amount of <br />$67,710.90. Both agreements earmark the transfer of the funds. <br />RECOMMENDATION: <br />Authorize the Chairman of the Board of County Commissioners to execute the <br />attached two compliance and restoration Cash Deposit and Escrow Agreements <br />with regard to the transfer from the second phase to the third phase. <br />/nhm <br />Attachments <br />Approved for May 10, 2016 BCC Meeting <br />CONSENT <br />COUNTY ATTORNEY <br />Indian River Co.
