DeBraal Deputy �v <br />p y County Attorney <br />May 10, 2016 <br />Grant of Utility Easement to the City of Vero Beach to Benefit the Boys and <br />Girls Club of Indian River County <br />The Boys and Girls Club of Indian River County, Inc., has completed construction of the addition to <br />their facility located at 1729 17th Avenue, Vero Beach. The underlying property is owned by Indian <br />River County and has been leased to the Boys and Girls Club since 2008 for a term of 50 years In <br />2014, the County added the old jail site property to that lease. The Boys and Girls Club demolished <br />the old jail and constructed a 14,000 square foot athletic and performing arts facility on the old jail <br />site. As a result of the construction, new utility easements are needed so the improvements can be <br />served by City of Vero Beach Utilities. In order to accommodate the improvements, the City of Vero <br />Beach has drafted the attached Utility Easement Deed and a Lessor Joinder and Approval for the <br />Board's consideration and approval. In accordance with the lease and as owner of the property, the <br />Board must approve the Utility Easement Deed and the Lessor Joinder and Approval of the Bill of <br />Sale for the utility equipment within the easements to be transferred to the City. The County will <br />have no maintenance obligation for the utility easement or the utility equipment listed in the Bill of <br />Sale <br />Staff has no objection to the Utility Easement Deed and the Lessor Joinder and Approval of the Bill <br />of Sale. <br />Funding. There is no funding associated with this request, as all recording fees will be paid for by <br />the other parties. <br />Recommendation. Staff recommends that the Board of County Commissioners approve the Utility <br />Easement Deed and the Lessor Joinder and Approval of the Bill of Sale and authorize the Chairman <br />to execute the documents on behalf of the Board. <br />Copies to- Wayne Coment, City of Vero Beach Attorney <br />Jessica Hawkins, Project Coordinator, MBV Engineering, Inc. <br />A�.
