Permission to File Suit 4560 32nd Avenue, Gifford <br />May 10, 2016 <br />2 1 P a g e <br />Due to the continuous illegal use of the property, Staff has asked the County Attorney's Office to <br />seek Board permission to file suit against Mr. Mason and the Gilberts. The suit will seek injunctive <br />relief ordering Mr. Mason to bring the property into compliance with the residential zoning code by <br />removing the offending vehicles and equipment. It is Staff's hope that the threat of incarceration for <br />non-compliance might force Mr. Mason to clean up the property. <br />Funding. Staff expects to spend about $600 in title work, filing fees and costs of service process. <br />Funding for the law suit is available from General Fund/County Attorney/Other Professional Services, <br />Acct # 00110214-033190 <br />Recommendation. Staff recommends that the Board of County Commissioners authorize the <br />County Attorney's Office to file suit against Mr. Mason and the Gilberts for injunctive relief and petition <br />for an Order commanding Mr Mason to bring the property into compliance with Indian River County <br />Code. <br />cc.
