With everybody having claims for attorney's fees <br />back against everyone else, the best thing to do, in his opinion, <br />is for everyone to walk away. <br />Commissioner Bird agreed and planned to make a motion along <br />those lines at the proper time. <br />Chairman Eggert recognized Mr. Scurlock speaking as an <br />individual. <br />Don C. Scurlock, Jr., felt Attorney Reynolds is absolutely <br />correct that we need to get on about our business and that we have <br />spent enough time on this. We spent from 9:30 in the morning to 9 <br />o'clock in the evening trying to mediate this and we were all in <br />different rooms. He had no idea what Guettler's proposal is or <br />isn't, nor did he assume Guettler knows his. We were all separate, <br />and the Mediator goes from place to place. Mr. Scurlock was <br />willing to settle this thing today, and also willing to settle <br />whether the County pays his attorney's fees or not, but he would <br />ask that the Board consider that Attorney Reynolds has indicated <br />that in four and one-half months, they haven't found the first bit <br />of evidence that, in fact, on the day of that vote he had a <br />conflict. His attorney's fees are $5,000, and that is what he <br />would request the Commission to pay him. He noted that this is the <br />second time that the County has had one of these situations. He <br />and Utilities Director Terry Pinto were involved a few years ago <br />with a frivolous suit, in his opinion, and in that case Mr. Stone's <br />attorney's fees of $25,000 were paid by the County. Mr. Scurlock <br />pointed out that as individuals, the Commissioners can be sued at <br />any time on any of their actions; in fact, he understood that Mr. <br />Fred Mensing has filed action against the Board. Attorney Reynolds <br />has stated that he looked for four and one-half months and has <br />found no concrete evidence of a conflict, and that should be <br />given <br />due consideration because $5,000 is not a lot of money. Mr. <br />Scurlock stated that he would settle, regardless, because that is <br />how important he thinks it is for the County to get on about its <br />20 <br />
