Commissioner Bird felt we are getting very sound legal advice <br />from our counsel who has stated our position very eloquently and <br />thoroughly. Commissioner Bird felt we should accept that advice <br />and resolve this matter here and today. <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Commissioner Wheeler, that the Chairman be authorized to <br />sign the letter to Prince Contracting Co., Inc. that has <br />been presented to us as our portion of the settlement in <br />the mediation process, and direct that the County take <br />care <br />of our legal fees <br />up to this point on <br />this matter <br />and <br />that Commissioner <br />Scurlock take care <br />of his own <br />personal legal fees and anyone else involved. <br />Under discussion, Chairman Eggert assumed that the Motion <br />means that the letter will be signed as soon as the lawsuit is <br />indeed dismissed and everybody has come to an agreement. <br />Attorney Reynolds stated that is correct. It would be his <br />intention that if the Board so votes today, to advise plaintiff's <br />counsel, Mr. Lawrence, that our portion is done as it would relate <br />to Prince and Guettler and that we have a pending recommendation as <br />it would relate to Mr. Scurlock individually. At that point, if <br />they say we have a go, then we're done, but if they say we have a <br />no go, then we have a trial. <br />THE CHAIRMAN CALLED FOR THE QUESTION.
