� r <br /> SECOND LEASE AMENDMENT AND MODIFICATION <br /> FOR BOYS AND GIRLS CLUB OF INDIAN RIVER COUNTY, INC. <br /> THIS SECOND LEASE AMENDMENT AND MODIFICATION ("Second Amendment') <br /> is entered into this 21st day of June, 2016 ("Effective Date"), by and between INDIAN RIVER <br /> COUNTY, a political subdivision of the State of Florida, 1801 27th Street, Vero Beach, FL <br /> 32960 ("County"), and BOYS AND GIRLS CLUB OF INDIAN RIVER COUNTY, INC., a <br /> Florida non-profit corporation, 1729 17th Avenue, Vero Beach, FL 32960 ("Tenant"). <br /> BACKGROUND RECITALS <br /> WHEREAS, the County and Tenant (the Parties) entered into a fifty (50) year Lease <br /> Agreement (Lease) on September 1, 2008; and <br /> WHEREAS, on June 4, 2013, the parties Executed a First Lease Amendment and <br /> Modification to include an additional adjacent parcel of property known as the Old Jail Site <br /> Parcel; and <br /> WHEREAS, the Tenant demolished the old jail building and constructed a new, 14,000 <br /> square foot athletic and performing arts facility on the old jail site; and <br /> WHEREAS, the Tenant completed the new project with private donations and not <br /> taxpayer dollars; and <br /> WHEREAS, in light of the improvements made to the property and the benefits flowing <br /> to the youth of Indian River County, the Tenant seeks to extend their existing lease from 50 <br /> years to 99 years so as to bolster fundraising opportunities and increase chances of grant <br /> approvals; and <br /> WHEREAS, the Indian River County Board of County Commissioners finds that use of <br /> public lands by the Boys and Girls Club of Indian River County, Inc. constitutes a public use <br /> and benefit. <br /> NOW, THEREFORE, upon the good and valuable consideration set forth herein, the <br /> Lease Agreement dated September 1, 2008 and First Amendment dated June 4, 2013, is <br /> hereby Amended and Modified as followed: <br /> A. The term of the Lease Agreement dated September 1, 2008, and First Amendment <br /> Dated June 4, 2013 is hereby amended and modified to expire August 31, 2107. <br /> B.
