FIFTH AMENDMENT TO EXTEND THE CONTRACT FOR PROVIDING ANIMAL <br /> SHELTER SERVICES FOR INDIAN RIVER COUNTY, FLORIDA <br /> This Fifth Amendment to Extend the Contract for Providing Animal Shelter Services for <br /> Indian River County, Florida, ("Fifth Amendment") entered into September_1--3 , 2016, by <br /> and between the Board of County Commissioners of Indian River County, a political <br /> subdivision of the State of Florida ("County") and the Humane Society of Vero Beach and <br /> Indian River County, Florida, Inc. a Florida not for profit corporation, ("Society"). <br /> BACKGROUND RECITALS <br /> WHEREAS, since October 1, 1995, the County and the Society entered into Contracts <br /> for Providing Animal Shelter Services for Indian River County, Florida ("Contract'); and <br /> WHEREAS, the Parties have renewed and extended this Contract on four different <br /> occasions, most recently on October 1, 2013, and the Parties desire to extend the Contract <br /> for an additional period of six (6) months; and <br /> NOW, THEREFORE, in consideration of the foregoing, and other good and valuable <br /> consideration, the receipt and sufficiency of which are hereby acknowledged, the County and <br /> the Society agree as follows: <br /> 1. The above Background Recitals are true and correct and are incorporated into this <br /> Amendment. <br /> 2. From and after the date of this Fifth Amendment, Article 3 is amended in its entirety <br /> and shall read as follows: <br /> This Contract shall be effective from October 1, 2016 until March 31, 2017, unless <br /> otherwise terminated according to the provisions of the Contract. <br /> 3. All terms and provisions of the Contract not amended by this Fifth Amendment shall be <br /> and remain in full force and effect. <br /> 1 <br />
